Home Care Helper

Terms of Use for Families

Home Care Helper Effective date: October 11, 2026 ยท Last updated: October 11, 2026

These Terms of Use ("Terms") are an agreement between you and The Home Care Helper Group LLC ("Home Care Helper," "we," "us," or "our"). They apply when you use homecarehelper.com, submit a care request through our website or an advertising-platform form, or talk or text with us (the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

PLEASE NOTE: Section 12 contains an arbitration agreement and class-action waiver that affect how disputes are resolved. You can opt out within 30 days, as explained there.

1. What we do

Home Care Helper is a free referral service. We learn what kind of in-home care you're looking for and connect you with one home care agency that serves your area. Home care agencies pay us a fee for each referral. That fee does not change what you pay the agency.

2. What we don't do

3. Who can use the Services

You must be at least 18 years old and live in the United States. If you submit information about someone else (for example, a parent who needs care), you confirm that you have their permission or the legal authority to do so.

4. Your information

You agree to give accurate information and to submit requests only for real care needs. Don't submit someone else's contact information without their permission, and don't submit false, prank, or automated requests. We may reject or delete any request.

Our Privacy Policy explains how we collect, use, and share your information, including that we share your request with one matched agency.

5. Consent to calls, texts, and emails

When you submit a care request and agree to be contacted, you authorize Home Care Helper and the one home care agency we match you with to contact you about your request at the phone number and email address you provide. This may include calls, text messages, and emails, and may use automated technology or prerecorded or artificial voices. This consent applies even if your number is on a federal, state, or company Do-Not-Call list. Consent is not a condition of any purchase or of receiving care. You can also reach us by email at support@homecarehelper.com instead.

You confirm that you are the subscriber or the regular user of the phone number you give us. If that number changes or is no longer yours, please tell us so we stop contacting it.

Call recording. Calls with Home Care Helper may be recorded and transcribed for quality, training, and record-keeping. We will tell you at the start of each call. By staying on the call after that notice, you agree to the recording. If you don't want to be recorded, tell us and we will help you by email instead.

You can withdraw consent at any time: reply STOP or END to any text, tell the caller you no longer want calls, or email support@homecarehelper.com. If you withdraw consent from us, we will tell the matched agency.

6. Text message terms

7. Acceptable use

Don't misuse the Services. For example, don't: break the law; interfere with or disrupt the Services; try to access accounts or data that aren't yours; scrape, copy, or collect data from the Services using bots or other automated means; reverse engineer the Services; impersonate anyone; use the Services or their content to train or improve artificial intelligence or machine-learning models; or use the Services to collect information for any other business.

8. Our content

The Services, including our name, logo, website, text, and graphics, belong to Home Care Helper or our licensors and are protected by law. You may use them only for your personal, non-commercial use of the Services.

Feedback. If you send us ideas, suggestions, or feedback about the Services, we may use them without any obligation to you.

9. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR MAKE ANY WARRANTY ABOUT ANY AGENCY OR THE CARE IT PROVIDES.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (A) WE ARE NOT LIABLE FOR THE ACTS, OMISSIONS, OR SERVICES OF ANY AGENCY OR CAREGIVER; (B) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; AND (C) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.

Release. Agencies and caregivers are independent of us. To the fullest extent allowed by law, you release Home Care Helper and its members, managers, employees, and contractors from claims arising from any dispute between you and an agency or caregiver, including claims about the care provided. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Residents of other states waive any similar law. This release does not apply where the law does not allow it, including for our own gross negligence or willful misconduct.

11. Indemnity

If you break these Terms or the law, or submit someone else's information without permission, you agree to cover our reasonable losses and costs (including attorneys' fees) from any resulting third-party claim, to the extent the law allows.

12. Arbitration and class-action waiver

Informal resolution first. Before starting a claim, please email support@homecarehelper.com and describe the problem. We'll try to resolve it within 60 days.

Binding arbitration. If we can't resolve it, you and Home Care Helper agree that any dispute relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. The arbitration may be held by video, by phone, or, if you prefer, in person in the county where you live. Either side may instead bring an individual claim in small claims court. Nothing here stops you from reporting a concern to a government agency.

Jury trial waiver. YOU AND HOME CARE HELPER EACH GIVE UP THE RIGHT TO A JURY TRIAL AND TO HAVE A JUDGE DECIDE A DISPUTE COVERED BY THIS SECTION 12.

Fees. If you start an arbitration, you will pay no more than $250 or the filing fee you would have paid to start the case in court, whichever is less. We will pay the rest of the AAA filing, administration, and arbitrator fees, unless the arbitrator finds your claim was frivolous or brought for an improper purpose. Each side pays its own attorneys' fees unless the law or the arbitrator's award says otherwise.

Mass filings. If 25 or more similar arbitration demands are filed against us or by us by the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules will apply, and the cases may be handled in batches of up to 100 so they can be resolved efficiently. Any statute of limitations is paused for cases waiting in a batch.

Class-action waiver. Disputes will be resolved only on an individual basis. Neither you nor we may bring or take part in a class, collective, or representative action. This does not stop you from seeking public injunctive relief where the law allows it; any such request will be decided by a court after the individual arbitration ends.

Opt out. You may opt out of this Section 12 by emailing support@homecarehelper.com with "Arbitration Opt-Out" and your name within 30 days of first using the Services.

Changes to this section. If we make a material change to this Section 12, we will give you at least 30 days' notice, and the change will not apply to a dispute you've already told us about.

If the class-action waiver is found unenforceable for a claim, that claim will go to court and not arbitration.

13. Governing law

These Terms are governed by the laws of the State of Florida and the Federal Arbitration Act, without regard to conflict-of-law rules. Except for disputes that go to arbitration or small claims court, disputes will be resolved in the state or federal courts located in the State of Florida.

14. Changes and termination

We may update these Terms. We'll post the new version here and update the "Last updated" date. If you keep using the Services after a change, you accept the updated Terms. We may suspend or end your access to the Services at any time if you misuse them.

15. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition, or sale of assets.

16. Notice for California users

Under California Civil Code Section 1789.3, California users are entitled to this notice: the Services are free for families. You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
